P.B. Gajendragakar, J.1. This appeal arises out of an industrial dispute between the appellant; M/s. Ganesh Flour Mills Co. Ltd., and its employees. The appellant company is a Joint StockCompany incorporated and registered at Delhi under the Indian Companies Act, 1913. It has three factories at Delhi, one Vegetable Ghee Factory, one Flour Mills and one Breakfast Food factory. It also runs a Vegetable Ghee Factory at Kanpur and a Vegetable Ghee Factory and a Flour Mill at Lyallpur in West Pakistan. For the accounting year 1952-53, the appellant's employees claimed bonus equivalent to six months' basic wages and annual increment in basic wages on the same scale as for the year 1948-49. The industrial dispute arising out of this claim was referred by the Chief Commissioner, Delhi to the Additional Industrial Tribunal, Delhi, on September 20, 1954. Sinha, J. 1. The main question for determination in this appeal by special leave is whether and, if so, how far non-compliance with the provisions of s. 173(4) and 207A(3) of the Code of Criminal Procedure, has affected the legality of the proceedings and the trial resulting in the conviction of the appellant. The appellant was tried by the learned Sessions Judge of Karimnagar in what used to be the State of Hyderabad (now part of the State of Andhra Pradesh), under s. 302 of the Indian Penal Code, for the murder of his brother Baga Rao, and sentenced to death. The conviction and the sentence were affirmed by the High Court of Judicature of Andhra Pradesh, at Hyderabad, on appeal and on a reference by the learned Sessions Judge. B.P. Sinha, J.1. This appeal by special leave is directed against the concurrent judgments and orders of the courts below convicting the appellant for the double murder of his mother Mst. Reoti Devi, aged about 65 years, and his infant son Sudhir, aged about 4 1/2 years, and sentencing him to death under Section 302, Indian Penal Code. There is also a conviction under Section 380 of the Indian Penal Code for the theft of his mother's jewellery and a sentence of two years rigorous imprisonment thereunder.2.
