The petitioners of both these writ petitions have challenged the constitutional vires of the Act known as Delhi Special Police Establishment Act, 1946 (Act No. 25 of 1946) and especially Sections 3, 5 and 6 thereof mainly on the ground that these provisions result in excessive delegation of legislative power to the Central Government and also result in encroachment over states power to legislate on the subject of police. (in liquidation) (hereinafter referred to as ' the company'), dated 14th August, 1972, rejecting the claim for priority in payment, claimed by the petitioner in repsect of an amount of Rs. 4,141.69. Petitioner claimed the aforementioned amount form the comapny. The liquidator admitted the claim against the comapny, but declined to given priority in payment as claimed by the petitioner under section 530(10(a) of the Companies Act. 1. The Textile Labour Association, Ahmedabad, on 21st April, 1961, gave a notice of change desiring privilege, casual and sick leave with wages for the workers employed in the textile industry. The privilege leave asked for was with pay and allowances at the rate of one month for every month of service with a right to accumulate the same for three months. The sick leave asked for was at the rate of one month for each year of service subject to a maximum period of twelve months during the whole service. The casual leave asked for was 15 days with full pay and allowances in a calendar year. In addition, pay in lieu of privilege leave was also asked for under certain circumstances. As the mills did not agree and as conciliation proceedings failed, the reference, being Reference (IC) No. 103 of 1961, came to be made. These petitions represent one more round in an almost unending litigation which seems to be going on between owners of mills and factories on the one hand and the Municipal Corporation of the City of Ahmedabad (hereinafter referred to as the Corporation) on the other since the last several years. The Corporation has been worsted in every round and every time it has tried to make good the legal infirmities in its claim by amendatory legislation but the attempt has been unsuccessful and the Courts have almost consistently struck it down.
