They allege that they have been regularly attending the classes during the academic year 2002-03 including the guest lectures and seminars conducted by the college. Though they were promised by the management of second respondent that attendance at guest lectures and seminars would also be reckoned for the purpose of calculating attendance as per B.Tech., course regulations, they were not given the benefit. Further, during the annual day function, the students were given five days preparation time but the same was not counted for the purpose of attendance and as and when the students did not adhere to dress code, absent was marked, as a result of all this, on the eve of annual/semester examinations on 30-4-2004, the petitioners were not issued hall tickets on the ground that they do not have...

1. Lack of legal authority to introduce 'Pay and Park' on the public streets of Bombay is the burden of the song sung by the petitioners. The petitioners are the resdients in the vicinity of khodaded Circle, Dadar T.T. , bombay , for the past over 30 years . It is their case in short that they have been parking their vehicles in the Khodadad Circle for a number of years. The said, area , being essentially a residential area, had not much of parking spece during night time except the said Khodadad Circle. The question herein is whether the Tamil Nadu Water Supply and Drainage Board is an institution established not for purpose of profit and thus excluded from the purview of Section 32(v)(c) of the Payment of Bonus Act, 1965. 2. The appellants herein in their respective petitions under Art. 226 of the Constitution claimed that the Act would apply to their cases. The respondents maintained that it would not apply. Learned Single Judge has held : 'The Board is an institution established not for purpose of profit within the meaning of Section 32(v)(c) of the Bonus Act. The dominant purpose of its getting established is not profit earning. It got constituted to execute schemes for providing protected water supply and adequate drainage facilities to urban and rural areas in the State of Tamil Nadu.
