M. a witness stated that the clerk of the court showed him the instrument, the signature of which he examined, and he believed it to be the handwriting of the party to it, with whose handwriting he was acquainted. Another witness stated that the instrument shown to M. was the original power of attorney. The letter of attorney purported to be executed and delivered by "James B. Clarke, of the City of New York, and Eleanor his wife," to "Carey L. Clarke, of the City of New York," on 7 October, 1796, in the presence of three witnesses. By th...
