Petitioner, an examinee at the Annual Higher Secondary Examination, 1989 (hereinafter described as 'the Examination') has filed this application under Article 226 of the Constitution of India, assailing the correctness of the marks awarded to her in some of the subjects for which she appeared.2. The factual position relevant for disposal of the writ application is as follows :The petitioner claims to be a student of extraordinary merit having secured very high percentage of marks in the Annual High School Certificate Examination. She appeared as a candidate at the Examination with Roll No. 2010162 in the Science stream with English and Modern Indian Language (Oriya) as compulsory subjects and Physics, Chemistry and Mathematics as optional subjects, with Biology as fourth optional subject. P.C. Misra, J.1. Appellants in this appeal were plaintiffs in a suit (O.S. No. 126/75-1) in the Court of Munsif, Bhadrak. The suit was dismissed on merits by judgment dated 12.12.1977 passed by the learned trial Court against which they preferred Title Appeal No. 2/78 in the Court of Subordinate Judge, Bhadrak. The said appeal was posted to 3.4.1980 for hearing on which day the Advocate appearing for the appellants filed an application praying for an adjournment on the ground of illness of their Advocate of Cuttack, who had been engaged to argue the appeal. The appeal was adjourned to 7.5.1980 on which day the appellants also applied for adjournment on the very same stand. The court reluctantly allowed adjournment on payment of cost of Rs. 100/- and the appeal was posted to 9.5.1980 for hearing. Plaintiff filed the suit alleging that he had married defendant No. 1 in 1956 and they continued to live as husband and wife till 20-11-1970. They had one female issue named Doleswari. Defendant No. 1 was suffering from the disease of syphilis which was in a communicable form and while the plaintiff was absent, defendant No. 1 deserting him eloped away with one Rama Sahu and had sexual intercourse with him and since then said defendant No. 1 is living in adultery with said Rama Sahu and has not returned to the plaintiffs house nor the plaintiff has cohabited with her at any point of time thereafter. On these averments it was pleaded that the marriage be dissolved or alternatively a judicial separation be granted.2. Defendant No. 1 denied the allegations made in the plaint.
