..... levels specified by the governor of a state by public notification to be the intermediate level for the purposes of this part :(d) 'panchayat' means an institution (by whatever name called) of self-government constituted under article 243b, for the rural areas ; (e) 'panchayat area' means the territorial area of a panchayat;(f) 'population' means the population as ascertained at the last preceding census of which the relevant figures have been published ;(g) 'village' ..... the supreme court while dealing with the provisions of article 243(e) of part ix of the constitution made the following observations in paragraph 11, which is as under :'11, the panchayats are to be constituted at the village, intermediate and district levels and the 'panchayat area' as defined by article 243(e) means the territorial area of the panchayat whether at the village, intermediate or district levels. ..... regarding creation of a new district by the name of auraiya, the governor is pleased to abolish the said district of auraiya and to alter the limits of the existing district of etawah by including areas of tehsils auraiya and bidhuna with effect from the date of publication of this notification in gazette,the governor is further pleased to direct that the jurisdiction of all legal proceedings commenced or pending on the ..... area' which means an area having population of ten lacs or more, comprised in one or more districts and consisting of two or more municipalities or panchayats or other contiguous areas .....

..... the answer to this question depends upon the proper interpretation of section 82(1) of the act, which reads as follows :'(1) all public water courses other than rivers passing through more areas than the panchayat area which the government may, by notification in the gazette, specify, springs, reservoirs, tanks, cisterns, fountains, wells, kappus, chals, standpipes and other water-works (including those used by the public to such an extent as to give a prescriptive ..... in the absence of a notification, the river in question which flows through more areas than one panchayat area stands transferred to and vest in the panchayat.for the reasons stated above, this appeal fails and it is dismissed. ..... it is by the said amendment that the expression 'all public water-courses other than rivers passing through more areas than the panchayat area which the government may specify' was introduced in sub-section (1) of section 82 of the act. ..... the expression 'other than rivers passing through more areas than the panchayat area which the government may by notification in the gazette specify' makes it clear that the power is given to the state government to specify by notification in the gazette the rivers passing through more areas than the panchayat area that shall not stand transferred to and vest in the panchayat. .....

..... the learned counsel made special emphasis on the last three sentences appearing in the above passage, and contended that, in so far as machinery has not been set up by the state government for trial of panchayat offences in any panchayat area as provided by rule 3 of the rules, the jurisdiction of the ordinary criminal court under section 5 of the criminal procedure code cannot be held to have been excluded, and that the first class magistrate ..... lastly contended by the learned counsel for the panchayat, that the rules have no application to a panchayat area, which does not fall within the jurisdiction of ..... no second class magistrate having jurisdiction over a panchayat area, the first class magistrate having jurisdiction in that area can take cognizance of and try the panchayat offences committed within the area of that panchayat. ..... the term 'magistrate' as follows:-- ' 'magistrate' means the magistrate having jurisdiction over the panchayat area, and in the case of a panchayat area comprised within the jurisdiction of more than one magistrate, such magistrate as may be authorised by the sub-divisional magistrate having jurisdiction, over the area. ..... of this decision, rule 3 was amended on 14-12-1967 by adding the following proviso thereto:-- 'provided that in the case of a panchayat the area of which does not fall within the jurisdiction of any second class magistrate, such offences shall be tried by a magistrate of the first class having jurisdiction over the panchayat area.' 4. .....
