1. This judgment deals with two appeals. The appeal No. 278 of 2006 has been preferred by Hind Metals & Industries Pvt. Ltd., herein referred to as 'Hind Metals'. The appeal No. 89 of 2007 has been preferred by Nav Bharat Ventures Ltd. which had been earlier known as Nav Bharat Ferro Alloys Ltd. and Nav chrome Ltd. and being referred to as 'Nav Bharat' in the judgment. Nav Bharat is respondent No. 1 in appeal No.278/2006. Hind Metals is respondent No. 2 in appeal No. 89/2007. The other party in both these appeals is the Orissa Power Transmission Corp. Ltd. which is a successor of Orissa State Electricity Board and is a transmission utility in the State of Orissa. 1. The appellant is a Government owned company having three power generating stations namely : 2. The respondent No. 2, Delhi Transco Ltd. is a transmission licensee.The appellant and the respondent No. 2 entered into a Power Purchase Agreement (PPA) on 30.03.2007. On 29.03.2007, the draft PPA had been approved by Delhi Electricity Regulatory Commission (DERC or Commission for short). Vide the impugned order dated 22.09.2006, the DERC decided the ARR and tariff applicable to the appellant for generation and sale of electricity from the aforesaid three power plants. The appellant, thereafter, filed a review petition, being No. 54/2006. 1. M/s Maharashtra State Power Generation Company Ltd., MSPGCL in short, (the Appellant) is a company formed under the Government of Maharashtra General Resolution no. ELA-003/P.K.8588/Bhag-2/Urja-5 dated 24 January 2005, after re-organization of the erstwhile Maharashtra State Electricity Board. The Appellant is in the business of generation of electricity in the State of Maharashtra. The Appellant submitted its application for approval of Annual Revenue Requirement (ARR) and Tariff Petition for the years 2005-06 and 2006-07 in February 2006 before the Maharashtra Electricity Regulatory Commission (MERC or the Commission).MERC through its order dated 7 September 2006 determined the ARR and tariff for the Appellant.
