The petitioner filed his complaint before the Commission on 5.3.1993 against the opposite parties for deficiency of service and seeks directions to opposite parties to pay it Rs. 5,00,000/- towards damages, loss of future profits and costs. 2. The case is as follows : The complainant wanted to organise a business promotion trip to Kathmandu in May/June, 1992 for 40 chit subscribers. It approached the opposite party No. 1 who assured that tickets for 40 persons by Royal Nepal Airlines from Delhi to Kathmandu on 28.5.1992 and return from Kathmandu to Delhi on 31.5.1992 would be arranged. On the basis of that assurance the complainant made its own arrangement for all the 40 subscribers to travel by Dakshin Express from Hyderabad to Hazrat Nizamuddin Railway Station (New Delhi) on 26.5.1992 and return journey from Hazrat Nizamuddin Railway Station to Hyderabad on 31.5.1992. Navabharat Enterprises Limited issued prospectus on 5.9.1994 for public issue of 52,73,400 Equity Shares of the face value of Rs. 10/- each on 29.9.1994 with a premium of Rs. 40/- per share. Shri V.N. Rai the complainant applied for 2,100 shares and a sum of Rs. 1,05,000/- and on allotment of 2,100 shares he paid a further sum of Rs. 5,000/- evidenced by Ex. A 2 and the share certificates were issued to the complainant as evidenced by the copies of the share certificates Exs. A3 to A23. Thereafter, he received as shareholder the 36th Annual Report for the financial year 1993-95 i.e. Ex. A24. The facts of the case are briefly as follows: The complainant claimed to have engaged the services of the opposite parties who represent one and the same cargo service but at different levels on 9-9-2005 paying freight charges to send consistent cashew kernnels from Chirala to Sri Reshma Enterprises, Adarshnagar, Beergang, Nepal. According to the complainant, the said consignment was never delivered to the said consignee as intimated to it by the consignee party. As such, the complainant claimed to have issued notices to the opposite parties but with no effect.
