Writ Petition No. 53782 of 2004. Appellant-Corporation is a local authority constituted under Uttar Pradesh Municipal Corporations Adhiniyam, 1959 (the Act). As a local authority, indisputably it has a large number of public duties and functions to perform; maintenance of slaughter house being one of them. Chapter XVI of the Act inter alia provides for regulation of slaughter houses. Sections 422 and 423 of the said Act, which are relevant for the purpose of this case are set out herein below:422. (Mild Steel) rods, bars or rounds. The question for consideration is whether they are entitled to a higher rate of development rebate specified in Section 33(1)(b)(B)(i)(a) and to relief under Section 80 (as it stood at the relevant time) of the Income-tax Act, 1961. The answer to this question entirely turns on whether the assessees are engaged in the manufacture or production of any one or more of the articles or things specified in the relevant Schedule to the Act. R.V. Raveendran, J.1. The appellants in these appeals are the employees of the first respondent-Bank - Ranchi Kshetriya Gramin Bank - now known as Jharkhand Gramin Bank. The appellants were working as clerks-cum-cashiers or equivalent posts in different branches of the first respondent-Bank. The Regional Rural Banks (Appointment and Promotion of Officers and other Employees) Rules, 1988 (for short `the Rules') made by the Central Government in exercise of powers conferred under the Provincial Rural Banks Act, 1976 governed the appointment and promotion of employees of the Bank. Rule 5 provided that all vacancies shall be filled in accordance with the provisions of the Second Schedule to the Rules. Entry (5) of Second Schedule to the Rules related to filling of posts of Field Supervisors (subsequently merged with the post of officers).
