In this writ petition a prayer has been made for of an appropriate writ in the nature of certiorari for quashing the notification of the State Government, Department of Urban development, dated 25-3-1998, as contained in Annexure 5 whereby the old elected body of Giridih Municipality in the year 1989 was allowed to function and the previous decision dated 23-6-1995 regarding dissolution of the municipal Board was cancelled. 2. The facts of the case are not in dispute. The general election of Giridih Municipality as per the provisions of the unamended Act, 1922 was conducted on 22-1-1989 and the election of the Chairman thereof was held on 15-5-1989 in the first general meeting of the Board of the Municipality. Admittedly the term of five years of the elected body was complete on 30-5-1994 and the grace period of six months as provided under the old Act had also expired on 30-11-1994. Respondent No. 7 is a resident of Village Kuberchak, Dhandiha Gram Panchayat. The petitioners are voters of Kulharia Gram Panchayat while respondent No. 7 is a voter of Dhandiha Gram Panchayat. Both Gram Panchayats are under the Koilwar Block district Ghojpur. Petitioner No. 1 and respondent No. 7 filed nominations for the post of Mukhiya of the Kulharia Gram Panchayat. The petitioner filed objection to the nomination filed by respondent No. 7 on the ground that he was not a voter of the Kulharia Gram Panchayat and therefore ineligible to file such nomination. The petitioner in effect prays for unseating respondent no.6 and for issuance of certificate of being elected as Mukhiya in her favour. The petitioner along with respondent no.6 and others contested election for the post of Mukhiya of Agion Gram Panchayat held in the year 2011. On 18.5.2011, the counting of the result of Agion Gram Panchayat concluded and the Returning Officer issued details of election result under rule 81(1) of the Bihar Panchayat Election Rules, 2006 (hereinafter referred to as "the Rules’). This writ application has been filed challenging the order dated 25.4.2009, passed by the Sub-Judge-1, Nalanda at Biharsharif in Case No. Election 2/07, filed on behalf of Sanju Kumari. Sanju Kumari stood for election for the post of a Ward Member in the Biharsharif Municipal Corporation Elections held in the year 2007. The ground for challenge of the said election is that it is alleged that 800 voters of Ward No. 39 have been shifted to Ward No. 37 which has caused tremendous prejudice to the petitioner as it was done at a belated stage after scrutiny of the nomination papers. The facts are that the date of filing the nomination for the candidates was fixed in between 27.4.2007 to 5.5.2007. The scrutiny was to be held in between 6.5.2007 and 7.5.2007.
