amareshwar sahay, j.1. the petitioner m/s bharat coking coal limited, a government company and a subsidiary of coal india limited has filed this writ application for quashing of the order dated 19/12/1990 (annexure-1), i.e. the order passed by respondent no. 4 the assistant settlement officer, dhanbad, rejecting the objection under section 83 of the chhotanagpur tenancy act filed by the petitioner, the order dated 19/03/1994 (annexure-2) passed by respondent no. 3 the charge officer, dhanbad, dismissing the revision filed by the petitioner under section 89(1) of the chhotanagpur tenancy act and also the order dated 27/03/1999 as contained in annexure-4, passed by the commissioner, north chhotanagpur division, hazaribagh, respondent no. 2 herein, disposing of the appeal filed by the petitioner, under section 89(2) of the chhotanagpur tenancy act read with rule 74 of the chhotanagpur tenancy rules.2. the dispute between the parties is with regard to 2.06 acres of land of c.s. plot no. 122, khata no. 14 out of the total area measuring 645.03 acres of land situated in village bherakatta of bastacola coal company limited, dhanbad.3. according to the petitioner, in the recent revisional survey operations, r.s. plot no. 9 was carved out from c.s. plot no. 122, which recorded in the khata of m/s bharat coking coal limited. the said r.s. plot no. 9 was ordered to be recorded in the name of respondent nos. 5 to 8 herein. the petitioner filed an objection under section 83 of the .....

d.g.r. patnaik, j.1. appellants namely, sona ram mahli (cr. appeal no. 130 of 1998), manki munda, thakur munda, harinath singh munda, behru munda, fulari munda, ram charan kumhar, gholtu kumhar and feklu munda (cr. appeal no. 157 of 1997), inderdeo mahto (cr. appeal no. 158 of 1997, budhu mahli (cr. appeal no. 177 of 1997) and behra munda, lulari munda, thakur munda and hari nath munda @ hari nath singh munda were convicted by the 5th additional judicial commissioner, ranchi for the offences under sections 364, 302, 201 and 34 of the indian penal code and was sentenced to undergo imprisonment for life for the offence under sections 364 and 302 ipc and three years for the offence under section 201 ipc vide sessions trial no. 216 of 1991/t.r. no. 24 of 1991. it appears however that cr. appeal no. 183 of 1997 (r) has been preferred by four appellants namely, behru munda, fulari munda, thakur munda and hari nath munda @ hari nath singh munda, white memorandum of appeal of cr. appeal no. 157 of 1997 (r) contains also the names of the aforesaid four appellants along with others. considering the above, names of the above named appellants, namely, behru munda, fulari munda, thakur munda and hari nath munda @ hari nath singh munda are deleted from cr. appeal no. 157 of 1997 (r)2. facts of the case in brief are that jawahar mian (deceased) was found missing from his house situated at village hesadih within the p.s. silli. district ranchi, from the late evening of 5.11.1990. six days .....

s.j. mukhopadhaya, j.1. all the three appellants, namely, gulam ali mian alias charka mian, basiruddin ansari (cr. appeal no. 2 of 1989) and jamiruddin ansari (cr. appeal no. 58 of 1989) have challenged the common judgment dated 17th december, 1998, passed by learned 2nd additional sessions judge, giridih, in session trial no. 61 of 1987. appellant gulam ali mian alias charka mian has been convicted under sections 302 and 109 of the indian penal code and sentenced to undergo rigorous imprisonment for life whereas appellants basiruddin ansari and jamiruddin ansari have been convicted under section 302/34 of the indian penal code and sentenced to undergo rigorous imprisonment for life. appellants gulam ali mian and basiruddin ansari have further been convicted under section 323 of the indian penal code and sentenced to undergo rigorous imprisonment for six months. however, the sentences passed against appellants gulam ali mian and basiruddin ansari have been directed to run concurrently.2. the incident, in question, which gave rise to the present case, occurred on 21st july, 1986, at about 7.00 a.m. the informant jan mohammad (p.w. 10) alleged that about 4 acres of lands belonged to his father nemtul mian and uncle gulam ali mian alias charka mian (one of the appellants), which was acquired by the irrigation department and as a compensation of the same, the informant's father nemtul mian received a bank draft of rs. 12,000/- and appellant gulam ali mian received another bank .....
