D.P. Gupta, J.1. This writ petition has been filed on behalf of the Life Insurance Corporation of India and arises in the following circumstances.2. The respondent No. 1. K.M. Rami, was initially appointed as an Assistant in the Life Insurance Corporation of India (hereinafter called 'the Corporation') on a temporary basis, on a cons dilated salary of Rs. 130/ per menses by the letter of appointment dated 29-11-58/23-12-58. The respondent No. 1 joined service with effect from December 26, 1958. The said respondent appeared at a test held by the Corporation for the purpose of recruiting probationary staff and was declared successful with the result that his temporary service was converted into probationary one with effect from September 28, 1959 and he was placed in the grade of Rs. 75,5,90 8 136 EB 160 10 220 EB 10-240-15 270. ORDERKan Singh, J.1. This is a writ petition under Art, 226 of the Constitution by one Shri Kalyan-mal Bhandari for an appropriate writ, direction or order. He has made a twofold prayer: firstly, he has prayed that the option that was taken from him by the Slate of Rajasthan for going to the service of the Rajasthan State Road Transport Corporation, hereinafter to be referred as 'the Corporation' was really no option and, therefore, the State Government be directed to take him back to its service and then be further directed to confirm him as upper division clerk from the year he was working as such and then give him all the consequential benefits. In the alternative, he has prayed that a direction be issued to the Corporation to confirm the petitioner on the post of upper division clerk from 30-11-55 and give him all consequential benefits resulting from such confirmation.2. This appeal has been filed by the claimants under Section 110-D of the Motor Vehicles Act, 1939 challenging the award of the Motor Accident Claims Tribunal, Bikaner dated 6th June, 1970. 2. On 2nd June, 1966 one Ram Kumar was looking after his truck on the road between Gajner and Bikaner at a distance of about 5 miles from Nail. A truck bearing No. R. J. K. 3528 driven by Niranjan Singh driver came from Bikaner side and dashed against Ram Kumar who was standing on the road. As a result of that accident Ram Kumar sustained serious head injuries. He was immediately removed to the hospital but his life could not be saved. Ram Kumar's wife Smt. Maina, his minor son Babu, minor daughter Panchu and mother Smt. Chandra filed a claim before the Motor Accident Claims Tribunal, Bikaner for Rs. 10,000/- as damages for the death of Ram Kumar.
