Sole plaintiff in Title Suit No. 14 of 1974 of the Court of Subordinate Judge, Rourkela filed this appeal. Defendant No. 2 in that suit claiming to be the purchaser of the suit land, has filed Cross Objection challenging to the finding recorded by Learned Subordinate Judge on issue No. 4. Both appeal and the cross objection are heard and disposed of by this common judgment.3. Admittedly, late Kanaihalal Nau was the owner of the suit land measuring an area of one and half decimals. In fact, he was owner of three decimals of land of plot No. 266, i.e., the suit plot. Admittedly he alienated one and half decimals of land to the sole plaintiff Muralilal Agrawal. Mohapatra, J.1. This second appeal has been filed by defendants 1 and 2 against the reversing judgment of Sri T.V. Rao, Subordinate Judge of Balasore, dated 15th July 1950, arising out of a suit brought by the original plaintiff Kangali Naik for declaration of title, for confirmation of possession, or, in the alternative, recovery of possession. Rushi and Kangali (the original plaintiff) were two brothers.Rushi is long dead leaving behind him his two sons Bhagirathi and Balaram. Both the brothers Bhagirathi and Balaram died in the same month, that is, October-November of 1939 and at an interval of nearly 10 or 12 days as the deaths were due to cholera. But nevertheless it is the admitted position that Balaram died first leaving behind him his only heir the widow Pitei. Pitei died after April 1944. C. challenging the order dt. 22-4-1982 decreeing the said suit.2. The opposite party filed the suit for realisation of a sum of Rs. 450/- together with pendente lite and future interest at the rate of 12 per cent per annum from the petitioner alleging, inter alia, that on 7-9-1981 the defendants purchased 115 pieces of grounds (Makhan) from the plaintiff for Rs. 450/- and promised to pay the price for the same within a week. After lapse of about one and half months on being reminded several times the defendants offered to pay Rs. 200/- only on the plea that the grounds being rotten could not be marketed.
