ORDER1. The Additional Small Cause Court, Nagpur granted a decree for possession, arrears of rent and mesne profits along with costs of the suit and an inquiry into future mesne profits from the date of suit till delivery of possession in favour of the plaintiff against the defendant-tenant, Prabhakar in Civil Suit No. 1522/1976; Krishna in Civil Suit No. 1427 of 1976; Balaji in Civil Suit No. 1521 of 1976; Onkar in Civil Suit No. 1031 of 1976; Nilkanth in Civil Suit No. 1648 of 1976 and Narayan in Civil Suit No. 1425 of 1976 vide judgment and decree dt. 15-9-1982. The defendant in each of these cases respectively has come up with revision application numbered respectively as above challenging the said judgment and decree.2. These three writ petitions under Article 226 of the Constitution of India challenge the constitutionality of Section 73BB of the Maharashtra Co-operative Societies Act, 1960 (Maharashtra Act No. XXIV of 1961) and of the Government Resolution No. CSL 1577/ 14599-15-C dated Sept. 13, 1977 issued by the Agriculture and Co-operation Department of the Government of Maharashtra. As the grounds of challenge in these petitions to the said section and the said Government Resolution are mostly the same, we have thought it convenient to dispose of these three petitions by a common judgment.2.
