The petitioner was appointed as Telecom Officer Assistant (in short 'TOA') vide order dated 31.10.1997 issued by the respondent No. 2, Chief General Manager, Mahanagar Telephone Nigam Limited (for short 'MTNL'). It is the case of the petitioner that although initially the petitioner was appointed in terms of order of appointment, which is dated 31.10.197, at pages 10 to 13 of the paper book, however the petitioner was confirmed on 23.12.197 and service of petitioner was regularised vide order dated 28.2.2002 w.e.f. 31.10.1999. The name of the petitioner figures at Seriall No. 124 of the order dated 28.2.2002 which is at page-25 of the paper book. 3. This application of the Petitioner for voluntary retirement was accepted by the Respondent on 18th January, 1994. In the order of acceptance which was communicated to the Petitioner inter alias it was stated that 'superannuating benefits will be applicable to you from the date of notional retirement viz. 31st March, 1995'. In furtherance to this letter the Petitioner was relieved from his duties which was accepted by him. The Petitioner in normal course would have retired on 1st April, 1995. Prior thereto the Petitioner moved an application to the Respondents for grant of retirement benefits including pension to the Petitioner. This letter was sent by the Petitioner to the Respondents on 23rd December, 1994. Jaspal Singh, J. (1) In the sprawling locality of Gandhi Nagar there is a conclave known as Raghubarpura No.2'. On August 5,1980 its Gali No.6-Bwas a witness to the murder of one Sukh Dayal. Two persons namely, Ishwar Singh and Mangat Ram were accused of having committed the crime and were consequently charged with and tried together, for an offence under Sec.302 read with Sec.34 of the Indian Penal Code. The trial court acquitted Mangat Ram. However, Ishwar Singh proved to be not that lucky and was convicted and sentenced to imprisonment for life under Section 302 of the Indian Penal Code. Even his appeal to the High Court failed. Aggrieved, he filed a Special Leave Petition (Criminal). Leave was not granted. The year was 1984. A question seemingly of some importance is involved in these two writ petitions, as to whether a notification under Section 4(1) of the Land Acquisition Act, 1894 (in short the 'said Act') as also Section 17 thereof, can be issued by a competent authority, pursuant to a direction issued by this Court. 2. The factual matrix of the matter is being noticed from CWP No.7648/00. 3. The petitioner therein purchased 149.5 sq. yds. of land in Khasra No. 573, Village Chandawli alias Shahdar, in the year 1958. A notification under Section 4 was issued for 1 bigha 19 bids was on 13th November 1959; whereafter, a declaration under Section 6 of the said Act was also issued on 1st November 1966.
