This is workman's writ petition under Articles 226 and 227 of the Constitution of India for setting aside the impugned award passed by the learned Labour Court, Patiala on May 12, 2009 disposing of IR No.473 of 2000. The relief of compensation in a sum of Rs. 35,000/- only has been awarded to the workman in lieu of reinstatement and back wages. The dispute arises from termination effected on July 15, 1985 by respondent PSEB while the petitioner was working as a work-charged Beldar amongst a host of other Beldars etc. in the Anandpur Sahib Hydel Construction Division No.1, Nangal, Punjab run by PSEB. He was employed on January 01, 1977 and had worked continuously and uninterruptedly till the date of termination. Initially, he did not take recourse to the remedy available under the Industrial Disputes, Act, 1947 ("the Act").
