Rajiv Sharma, J.1. The present petition has been filed against Annexures P-3, P-5 and P-8, dated 14.7.1998, 14.3.2000 and 2.6.1999, respectively.2. The brief facts necessary for adjudication of this petition are that the petitioner was recruited as Sepoy in the Indian Army on 8.4.1980. Initially, the petitioner was recruited in the Punjab Regiment, but subsequently he was shifted to Intelligence Corps. He was promoted to the rank of Naik on 1.1.1988 and was subsequently promoted to the rank of Havaldar on 1.1.1991. The petitioner was posted to Field Security Company, 8, Mountain Division with effect from 14.1.1997. He was sent to perform his duties with 53 Infantry Brigade. The State has challenged the judgment of learned Sessions Judge, acquitting the respondents for offences under Section 304-B and 498-A read with Section 34 of the Indian Penal Code. 2. The brief facts necessary for consideration in this appeal are that the deceased Alka alias Ashu was the daughter of Roop Lal and was married to respondent No.3 Sheetal Kumar son of Sh. Devinder Dutt. Their marriage was performed despite opposition from the parents of the deceased. The undisputed fact is that it was a love marriage. On 13.9.2000, the marriage was solemnized at Rajgarh. The undisputed facts are that the works pertaining to strengthening of Chandigarh-Mandi-Manali road NH- 21 in K.M. 105/0 to 127/0 was awarded by the respondent-State in favour of the Appellant-Contractor. The contract provided that in case the deviation in the work was beyond 30% the contractor would be entitled to claim payment for the works in excess of 30% of the awarded quantity at market rate. The agreement entered into between the parties also contained an arbitration clause. The contractor claimed that he had in respect of certain works been required to carry out work in excess of the prescribed deviation of 30% and therefore he was entitled to be paid for such works in excess of the stipulated deviation at the market rates.
