Singh, J. 1. This is an appeal by the plaintiff against the dismissal of her suit for damages for personal injuries sustained in a motor accident. 2. The facts that the plaintiff alleged were that on June 12, 1959 she was going in Bus No. MPJ 1690 -- belonging to the Madhva Pradesh State Road Transport Corporation, from Jabalour to Chhindwara. A truck bearing No. MPJ 9310 owned by Bakhatwarsingh, defendant No. 2. was Coming from the opposite direction-There was a head-on collision between the two vehicles at a distance of about seven miles from Jabalpur. As a result of this impact, the plaintiff received severe injuries to her right elbow causing multiple fractures. It was further pleaded that the injuries have resulted in a permanent disability of the right hand. Both the drivers, according to the case of the plaintiff, were driving the respective vehicles in utter disregard of the rules of driving and without any regard to the safety of passengers. The subiect matter of the suit is a Cinema House formerly known as 'Gulab Talkies' and now 'Central Talkies' Jabalpur. A Single Bench of this Court by order, dated 16-4-1971, has referred the question of Court-fees to a larger Bench in view of the conflict of opinion in some cases which presently we propose to mention. 2. This is a revision under Section 115 of the Code of Civil Procedure, which is directed against an order, dated 24-11-1970, passed by the Civil Judge, Class II, Balhar, in Civil Suit No. 21-A of 1968, holding that the question of court-fees is governed by Section 7(v)(c) of the Court-fees Act and, therefore, the trial Judge required the petitioner-plaintiff to pay court fees on fifteen times the mesne profits. The petitioner filed a suit for possession of two fields, namely, khasra Nos. 104/1 and 112, measuring 7.37 acres and 0.53 acres respectively and assessed to land revenue of Rs. 3/- and 0.50 paise respectively as annual land revenue. In Miscellaneous (First) Appeal No. 7 of 1972 a question arose whether a temporary injunction can be issued to restrain a decree-holder from executing his decree against his judgment-debtor.
