The petitioner, a Cooperative Society, was registered in the year 1958 at Delhi under the Bombay Cooperative Societies Act, 1925 (hereinafter referred to as the Bombay Act) as extended to the State of Delhi. This Society has a branch office at Calcutta. Some time in August, 1970, the opposite party instituted a suit against the petitioner in the Citv Civil Court at Calcutta claiming damages amounting to Rupees 43,370/- for alleged breach of contract. In its written statement the Society raised inter alia a question as to the maintainability of the suit in view of Section 70of the Bombay Act. ORDERSabyasachi Mukharji, J. 1. This is a petition for winding up of the company. The company in question is Pandam Tea Company Limited. The petitioner Raghunath and Sons Private Ltd. claims to be a creditor of the said Company in respect of moneys lent and advanced during the 14th July, 1958 and 19th December, 1967. As a result of these transactions and repayments according to the petitioner, a sum of Rs. 1,58,875.25 remained unpaid upto 30th June, 1967. Thereafter interest had accrued due to the petitioner and the petitioner has filed this petition for a claim of Rs. 2,67,492.72. According to the petitioner, the said liability or debt of the petitioner had been acknowledged by the Company in the balance-sheets of the company year after year from 1958 to 1968. This is an appeal by the petitioner against an order dated July 2, 1971, passed by Banerjee J. discharging the rule obtained by the petitioner against proceedings initiated against him under Section 34 of the Indian Income-tax Act, 1922. The case of the complainant was that the Food Inspector of the Municipality saw the accused carrying two cans of milk for sale on the carrier of his bicycle on 10-9-68 at about 8-30A.M. He stopped him and intimated the accused-opposite party that he would take samples from the milk of his cans. He gave the opposite party a notice in writ-Ing under Section 11(1)(a), took sample of milk, separated that sample into three parts, added 40% formalin as preservative and after sealing, labelling and fastening all the three parts sent one part, to the Public Analyst for analysis. This second appeal arises out of a suit filed by the plaintiff-appellant for confirmation of his possession in the disputed property and for a permanent injunction upon a declaration of his title thereto. The plaintiff purchased the suit land from one Dud Ali Mollah under a registered kobala dated 22nd Ashar, 1361, B. S., corresponding to 7th July, 1954 and was in possession since the purchase of the property. The plaintiff's case is that the defendant had no title in the land and was wrongfully trying to interfere with his possession. The main defence of the defendant is that the suit property was attached in execution case No. 17 of 1954 on 19-5-1954 and the suit property was purchased by him in a court-sale on 9-5-1955.
