The J&K; Board of Professional Entrance Examination vide its advertisement Notice No. 02-BPEE of 2008 dated 25-1-2008 dated 25-1-2008 invited applications for admission to MD/MS/PG Diploma /Degree Courses. The petitioner was one of the candidates who offered her candidature. In the Exam/Test conducted by the Board of Professional Entrance Examination (hereinafter to the referred as the 'Board') the petitioner secured 236 marks out of 300 in Open Merit Category. The last selected candidate in the Open category had secured 213 marks. Respondent No. 7 Shaista Rashid who was a candidate under RBA category obtained 247 marks. Additional District Judge, Bank Cases, Jammu dated 6.7.2007 whereby petitioner's application for setting aside ex parte decree has been dismissed.2. A suit for recovery for an amount of Rs. 9,26,169.26 NP was filed before the Additional District Judge, Bank Cases, Jammu. Notices were issued to the defendants. Defendant No. 1 petitioner did not appear despite service and consequently the case was set exparte against defendant No. 1 on 14.9.1998. It is alleged in the complaint that accused 2 and 7 published news item in Early Times in its issued dated 6.7.2005 levelling allegation that Mr. Raj Daluja not only cheated the court but has also deceived the police department. It is also alleged in the said complaint that the woman who was photographed nude with Gopal Arya Mission Proprietor Ashok Mahajan, was also a teacher of JK Public School. Hakim Imtiyaz Hussain, J.1. 313 posts of teachers for District Baramulla falling within District cadre were notified by the State Service Selection Recruitment Board vide advertisement notice 1 of 1999 dated 9.3.2001. The qualification required for the post was 10+2 with 50% marks and above. The notification prescribed that 50% marks will, not apply to graduates and above and that experience was to be given preference. The notification further provided that the prescribed qualifications were minimum and mere possession of the same will not entitle a candidate to be called for interview and that in the event of the number of candidates for the post being large, the board shall restrict the number of candidates to be admitted in oral or written test in terms of Sub-clause (ii) of rule 13 of SRO 194 of 1992.
