25. 01-2012 Petitioner is apprehending his arrest in a case registered for the offences under Sections 147, 148, 149, 342, 323, 452, 380, 427, 504 of the I.P.C. Accusation is of entering into the house of the informant, assaulting the informant and her son and also taking away ornaments and damaging the portion of under construction house. It appears from the impugned order that informant subsequently retracted from initial version and filed a petition to that effect and on that basis, others have been granted bail by learned Court below. It is submitted by learned counsel for the petitioner that for the occurrence of 04.06.2010, the F.I.R. was lodged on 10.07.2010. Considering the fact that others have been granted bail by learned Court below, I see no reason by learned Court below not to give the same privilege to the petitioner, preferably on the same day, if the petitioner surrenders within a period of six weeks from today in connection with Kurhani P.S. Case No. 153 of 2010, pending in the Court of learned S.D.J.M., West, Muzaffarpur. With the observations above, the application stands disposed off.
