Judgment:
IN THE HIGH COURT OF JUDICATURE AT PATNA Criminal Miscellaneous No.35623 of 2011 Rajiv Singh @ Gudri Singh Versus The State Of Bihar ----------- 03/ 12.01.2012 Supplementary affidavit is filed on behalf of the petitioner. Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner being husband of the deceased is in jail custody since 7.7.2010 in a case registered under sections 304B, 201/34 of the IPC. It is contended by learned counsel for the petitioner that according to the prosecution case itself marriage had taken place 7 years ago and moreover, informant claimed that he came to know about the alleged occurrence from one Ramprit Singh. It is further contended by him that the aforesaid Ramprit Singh has been examined as prosecution witness in trial of co-accused and the said Ramprit Singh has stated nothing against the petitioner and other accused persons. Admittedly, case has been registered under sections 304B, 201/34 of the IPC and the dead body of the deceased was recovered beneath heap of cow mud on the basis of disclosure made by the petitioner. Considering the aforesaid facts and circumstances as well as submissions of the parties and also keeping in mind the statement of the witnesses recorded during the course of investigation, I am not inclined to release the petitioner on bail. -2- Accordingly, his prayer for bail in connection with Nayagaon P.S. Case no. 41/2010 corresponding to Sessions Trial no. 336/2011 pending in the court of learned Addl. Sessions Judge FTC No. I, Begusarai is, hereby, rejected.
