17. 01-2012 Heard learned counsels for the petitioners and the State. The petitioners are languishing in custody since 01.08.2011 in a case registered for the offence under Sections 399, 402, 307, 332, 333, 353 of the I.P.C. and 25(1-B)(a), 26, 35 and 27 of the Arms Act. From possession of petitioner Rabi Yadav @ Rabi Kumar one country made pistol alongwith live cartridges were recovered whereas from possession of petitioner Manish Kumar one country made pistol loaded with empty cartridges and three Patna High Court Cr.Misc. No.40 of 2012 (2) dt.17-01-2012 live cartridges including one Nokia Mobile were recovered. It is submitted that both the petitioners are involved in one other case apart from the present case in which they are on bail.
