Judgment:
IN THE HIGH COURT OF JUDICATURE AT PATNA Criminal Miscellaneous No.33267 of 2011 Wasim Khan Versus The State Of Bihar ---------------------------------- 02. 18.01.2012 Heard learned counsels for the petitioner, complainant and the State. Petitioner being husband is apprehending his arrest in a complaint case in which cognizance has been taken under Sections 498A of the I.P.C. and Section of the Dowry Prohibition Act. Petitioner and O.P. No. 2 are present before this Court and both sides are ready for resumption of conjugal life. Petitioner undertakes to bring the complainant from her house to her matrimonial house within a period of two weeks to keep her as wife with full dignity and honour, though O.P. No. 2 is little apprehensive due to the past conduct of the petitioner but she is ready for resumption of conjugal life. In the circumstance, let the petitioner namely Wasim Khan, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Gaya in connection with Complaint Case No. 883 of 2010. The complainant will be at liberty to file appropriate application for cancellation of bail of the petitioner, if the petitioner fails to comply the undertaking given before this Court.
