1 in the high court of judicature for rajasthan at jodhpur :order: s.b. civil writ petition no.1856/2008 (doongar ram vs. adj no.1, jodhpur & ors.) date of order ::05. 02.2013 hon'ble mr justice gopal krishan vyas mr. sajjan singh, for the petitioner. mr. khet singh, for respondent no.5. heard learned counsel for the parties. in this writ petition filed under article 227 of the constitution of india, the stay is operating since 4.4.2008 for maintaining status quo. learned counsel for the petitioner submits that earlier trial court granted interim injunction upon application for temporary injunction in favor of the petitioner plaintiff but later on the said interim injunction passed by the trial court was reversed by the appellate court. in view of the fact that in this petition, stay is operating since 2008, the writ petition is disposed of with the direction to the trial court to decide the suit itself within one year from the date of receipt of certified copy of this order and till disposal of the suit, the stay order granted by this court shall remain in force. 05. 02.2013 HON'BLE MR JUSTICE GOPAL KRISHAN VYAS Mr. Sajjan Singh, for the petitioner. Mr. Khet Singh, for respondent No.5. Heard learned counsel for the parties. In this writ petition filed under Article 227 of the Constitution of India, the stay is operating since 4.4.2008 for maintaining status quo. Learned counsel for the petitioner submits that earlier trial Court granted interim injunction upon application for temporary injunction in favor of the petitioner plaintiff but later on the said interim injunction passed by the trial Court was reversed by the appellate Court. In view of the fact that in this petition, stay is operating since 2008, the writ petition is disposed of with the direction to the trial Court to decide the suit itself within one year from the date of receipt of certified copy of this order and till disposal of the suit, the stay order granted by this Court shall remain in force.
