hon'ble mr. george paracken, judicial member the applicant is working as executive engineer in bsnl. while he was working as assistant engineer in the erstwhile postal civil division some incident took place in the year 1994 for which he was charge sheeted on 29.7.2008 by annexure a-1 memorandum. the only request of the applicant is that since his grade promotion is due in the month of october, 2009 and he is to superannuate on 30.4.2010, the disciplinary proceedings pending against him shall be finalised as early as possible. he has also pointed out that the inquiry report has already been submitted by annexure a-5 dated 30.7.2009. 2. in view of the above position, we are of the view that the request of the applicant is quite justified. we, therefore, direct the 1st respondent who is the disciplinary authority or any other competent authority to ensure that necessary decision on the inquiry report shall be taken and communicated the same to the applicant within a period of two months from the date of receipt of a copy of this order. the o.a is disposed of accordingly. there shall be no order as to costs.

The applicant is working as Executive Engineer in BSNL. While he was working as Assistant Engineer in the erstwhile Postal Civil Division some incident took place in the year 1994 for which he was charge sheeted on 29.7.2008 by Annexure A-1 Memorandum. The only request of the applicant is that since his grade promotion is due in the month of October, 2009 and he is to superannuate on 30.4.2010, the disciplinary proceedings pending against him shall be finalised as early as possible. He has also pointed out that the inquiry report has already been submitted by Annexure A-5 dated 30.7.2009.

2. In view of the above position, we are of the view that the request of the applicant is quite justified. We, therefore, direct the 1st respondent who is the disciplinary authority or any other competent authority to ensure that necessary decision on the inquiry report shall be taken and communicated the same to the applicant within a period of two months from the date of receipt of a copy of this order. The O.A is disposed of accordingly. There shall be no order as to costs.
