Judgment:

The applicant while working as a Chowkidar was issued with a charge sheet under Rule 14 of the CCS (CCA) Rules. According to the applicant, he did not understand the enquiry proceedings held against him as the enquiry was conducted in English language and he was not aware of that language. The only language he knew was Malayalam. He has also submitted that the inquiry officer himself was from Tamilnadu who did not know Malayalam. The inquiry officer submitted the report holding him guilty of the charges leveled against him. He has also submitted that without giving him a copy of the enquiry report the Disciplinary Authority has imposed upon him the punishment of compulsory retirement from service. He made the statutory appeal under Rule 23 of CCS (CCA) Rules but no decision was taken by the Appellate Authority so far. He has, therefore, send the Annexure A-4 reminder with certain additional grounds challenging the enquiry report and the Disciplinary Authority's order. Even then the Appellate Authority has not disposed of the appeal so far.

In the above facts and circumstances of the case, counsel for the applicant has submitted that he will be satisfied if a direction is given to the Disciplinary Authority to dispose of the Annexure A-3 and Annexure A-4 representations of the applicant within a definite time frame. Counsel for the respondents also has no objection in disposing of this OA in the aforesaid manner.

We, accordingly, direct the 2nd respondent, namely, the Protector General of Emigrants, Ministry of Overseas Indian Affairs, New Delhi to dispose of the Annexure A-3 and Annexure A-4 statutory appeals of the applicant within a period of two months from the date of receipt of a copy of this order.
4. With the aforesaid directions this OA is disposed of. There shall be no order as to costs.
