.....in view of the submissions made by the learned counsels appearing on either side, the first respondent is directed to dispose of the representation, dated 18.10.2010, on merits and in accordance with law, after giving an opportunity of hearing to the petitioner and the other persons concerned, if any, within a period of twelve weeks from the date of receipt of a copy of this order. the petitioner is directed to furnish a copy of the representation, dated 18.10.2010, to the first respondent, along with a copy of this order. however, it is made clear that this court, by this order, has not expressed any opinion on the merits of the matter. 5. accordingly, the writ petition is disposed of, with the above directions. no costs. connected m.p.no.1 of 2011 is closed.

Judgment:


PRAYER: Petition filed under Article 226 of the Constitution of India, praying for a Writ of Mandamus, directing the 1st respondent to include the petitioner's name in the seniority panel list as per proceedings of B.P.No.Ms.(F.B.) No.65 dated 12.8.1985 (by Administrative Branch) Para 3 Sub Clause (iv).

O R D E R

1. Mr.S.P.Prabakaran, the learned Additional Government Pleader, takes notice for the respondents.

2. Though the prayer is for a larger relief, the learned counsel appearing on behalf of the petitioner had submitted that it would suffice, if the first respondent is directed to dispose of the representation, dated 18.10.2010, on merits and in accordance with law, within a specified period.

3. The learned Additional Government Pleader appearing on behalf of the respondents, has no objection for such an order being passed by this Court.        

4. In view of the submissions made by the learned counsels appearing on either side, the first respondent is directed to dispose of the representation, dated 18.10.2010, on merits and in accordance with law, after giving an opportunity of hearing to the petitioner and the other persons concerned, if any, within a period of twelve weeks from the date of receipt of a copy of this order. The petitioner is directed to furnish a copy of the representation, dated 18.10.2010, to the first respondent, along with a copy of this order. However, it is made clear that this Court, by this order, has not expressed any opinion on the merits of the matter.

 5. Accordingly, the writ petition is disposed of, with the above directions. No costs. Connected M.P.No.1 of 2011 is closed.
