Judgment:
Prayer: Writ Petition filed under Article 226 of the Constitution of India seeking for the relief of issuance of writ of mandamus directing the respondents to conduct an enquiry on the representation of the petitioner dated 13.12.2010 and to decide the same on merits within a time limit that may be fixed by this Court.
ORDER
1. The petitioner seeks writ of mandamus directing the respondents to conduct enquiry on the petitioner's representation dated 13.12.2010 and to decide the same on merits.
2. Heard Mr.D.Lingeswaran, learned counsel appearing for the petitioner and Mrs.T.P.Savitha, learned Government Advocate appearing for respondents.
3. The land measuring 120x 60 = 7200 sq.ft comprised in S.No.408/1 (new Survey No.582/18) at Manapakkam village, Sriperumbudur Taluk, Kancheepruam District was originally classified as Grama Natham. According to the petitioner, his ancestors were in enjoyment of portion of the said property. Further case of petitioner is that while issuing patta under Grama natham scheme, the respondents have included the above said piece of land in the name of adjacent occupied owner viz., Nageswari, wife of Dhakshinamurthy. Further case of petitioner is that in this regard the petitioner had given a representation to the respondents on 13.12.2010 asking them to conduct an enquiry and for suitable action. In this regard, the 1st respondent has also sent a proceedings in O.Mu.4449/2010/A2 dated 14.12.2010 calling upon the 2nd respondent to conduct an enquiry. Alleging that inspite of such proceedings of the first respondent, 2nd respondent has not conducted enquiry, the petitioner has filed this writ petition seeking for writ of mandamus.

By perusal of the typed set of papers it is seen that in O.Mu.4449/2010/A2 dated 14.12.2010, the 1st respondent has directed the 2nd respondent to hold an enquiry on the petitioner's representation dated 13.12.2010. Without expressing any opinion on the merits of the matter, 2nd respondent is directed to conduct an enquiry on the petitioner's representation after issuing notice to the petitioner and the neighbour - Nageswari, wife of Dakshinamurthy and all other persons concerned and the 2nd respondent shall afford opportunity to the petitioner and also Nageswari, wife of Dakshinamurthy and all other persons concerned and pass appropriate orders preferably within a period of four months from the date of receipt of copy of the order. It is made clear that this Court has not expressed any opinion on the merits of the matter.
With this observation, the writ petition is disposed of. However, there is no order as to costs.
