.....and the informant has been settled and a compromise petition has been filed in the court below. considering the above aspect of the matter, the petitioners sujeet kumar choudhary alias sujit chowdhary, suresh kumar mandal, aslam khan, mukesh kumar pathak and dilchand gop alias dilchand gope are directed to surrender before the court below within a fortnight positively from the date of this order and on their surrender, they shall be released on bail on furnishing bail bond of rs.10,000/- ( rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the chief judicial magistrate giridih in connection with giridih (muffasil)p.s. case no. 286 of 2010 (gr no. 2159 of 2010) subject to the conditions laid down under section 438(2) cr.p.c.

Judgment:


1. Heard the learned counsel for the petitioners and the learned counsel for the State.

2. This is an application for grant of anticipatory bail filed by the petitioners in connection with Giridih (Muffasil)P.S. Case No. 286 of 2010 (GR No. 2159 of 2010) for the offences registered under sections 467/468/471/34 of the Indian Penal Code, pending in the Court of the learned Chief Judicial Magistrate Giridih.

3. There is allegation against the petitioners that they, in collusion with the supplier, had submitted a wrong report with regard to the iron ore causing loss to the informant. It appears that the petitioners were influenced by the supplier for some benefit or the other.

4. It is submitted that the matter between the accused petitioners and the informant has been settled and a compromise petition has been filed in the court below. Considering the above aspect of the matter, the petitioners Sujeet Kumar Choudhary alias Sujit Chowdhary, Suresh Kumar Mandal, Aslam Khan, Mukesh Kumar Pathak and Dilchand Gop alias Dilchand Gope are directed to surrender before the court below within a fortnight positively from the date of this order and on their surrender, they shall be released on bail on furnishing bail bond of Rs.10,000/- ( rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate Giridih in connection with Giridih (Muffasil)P.S.
