Information Sought: Information regarding names of officials who were staying at places other than the place of posting and were paid HRA in 2005 for the last pay revision. PIO’s Reply: The PIO held that no information can be provided as no such record is or was maintained in the bank as desired by the Appellant Grounds for First Appeal: The Appellant was not satisfied as the PIO denied from giving any information. Order of the First Appellate Authority: The FAA stated that information which is not held by the Public Authority cannot be provided. Hence, FAA upheld with the PIO’s decision. Grounds for Second Appeal : The Appellant was not satisfied as the information was denied on false grounds and aggrieved that appeal was dismissed ignoring Bank’s own instructions.
Relevant Facts emerging during Hearing: The following were present Appellant : Mr. Chand Singh on video conference from NIC-Faridkot Studio; Respondent (1): Mr. Surjeet Singh Sachdeva, PIO & Chief Manager on video conference from NICLudhiana Studio; Respondent (2) : Mr. Lekh Raj Chugh, Sr. Manager on behalf of Mr. A. S. Jolly PIO & Chief Manager New Delhi; The appellant has asked for certain information which the PIO has said is not available. The Appellant tells the Commission that he would be satisfied if he is provided the list of officers from whom arrears were recovered as per letter no. 6572 dated 14/09/2005 issued by Zonal Office Ludhiana.
Decision: The Appeal is allowed. The PIO Mr. Surjeet Singh Sachdeva is directed to provide the information as directed above to the Appellant before 05 November 2011.
