The RTI application dated 23.2.11   was filed by the Applicant with the Sub Divisional Magistrate,  Najafgarh, New Delhi.  He sought information about the action taken on his complaint dated 24.1.11  besides   name of the official responsible for dealing with it,   as also copies of comments and file  notings with respect to his complaint.  The PIO replied on 21.3.11 providing point wise information.  Not satisfied with this reply the Applicant filed his first appeal on 30.3.11 to which the Appellate  replied on 30.4.11 in  stating that he has held a hearing and that  the Appellant was present for the  same.   The   Appellate   Authority   further   stated   that   after   hearing   both   sides     he   is   directing   the  PIO/SDM(NG) to  personally look into the Appellant’s complaint and submit a report to him  within 15  days of receipt of  his Order  On  not receiving the required information from the PIO, the Appellant  filed thereafter  filed a second appeal before the Commission.

Decision. 

 2 . The Commission after perusing the submissions on record,   directs the PIO   to comply with the  directions of the Appellate Authority in his Order  dated 30.4.11 and  to submit the report as directed  by the Appellate Authority to the Appellant by 31st October 2011 under intimation to the Commission. 

It is also recommended  that the Appellate Authority take appropriate action against the PIO for  not  having  complied with  his (Appellate Authority’s) order. 3. The  appeal is accordingly disposed off.  (Annapurna Dixit) Information Commissioner
