ORDER Background

1. The   Applicant   filed   his   RTI­application   dated   19.04.2011   with   the   PIO,

 

Northern Railway, DRM office, New Delhi, seeking certain information about the booking income and  expenditure in respect of all the Wedding Halls   of Delhi Division, belonging to the Railways. The PIO,  Sampada Branch, on 23.05.2011, informed the Applicant that the information sought by him pertains to  the Personnel Branch. The Appellate Authority,  in response to the Appellant’s 1st­appeal dated 23.052011  to him, passed an order dated 27.06.2011. Through this order, the AA asked the  Divisional  Secretary,  NRMU to provide the information to the Appellant as the same is being held by the NRMU. He also  directed the Sr. DPO to furnish information to the Appellant on the policy matter. Since the Appellant, did  not   receive  any   information  from  the  NRMU, he  filed  the  present appeal before  the  Commission on  19.07.2011 requesting for the disclosure of complete information. During the hearing, the Respondents maintained that the information sought by the Appellant here is held  by the Divisional Secretary, NNRMU, who, however, despite their reference to him, has not supplied any  information to the Appellant. On being enquired by the Commission about the status of the NRMU, they  stated that the NRMU is a Union of employees  of the Public Authority, the Railways, which is entrusted  with the job of management of Railway Barat Ghars— a property of Ministry of Railways.

In view the above, it is directed that the Divisional Secretary, NRMU, New Delhi,  within 1 month  of  receipt of this order, shall furnish the required information to the Appellant, corresponding to his present  RTI­application. He is also required to explain to the Commission why he failed to furnish the information 

to  the  Appellant  despite  the  Appellate Authority’s direction. He should file his explanation before the  Commission by 31.10.2011.

The   next   hearing   in   the   matter   shall   be   held   on  02.11.2011   at   04:30   p.m.  to   examine   the  reply/explanation of the Divisional Secretary, NRMU, New Delhi. All the parties including the Divisional  Secretary, NRMU, New Delhi are therefore directed to ensure their presence before the Commission on  the said date. The representative of NRMU to also carry with him a copy of the information provided to the  Appellant.

Matter is adjourned with the above directions.
