1. Latest affidavit dated 06.10.2015 by one Sri K. Ravi Kumar, Director of Industries, Department of Industries (Government of Jharkhand) has been filed in which, it is stated that the Screening Committee scrutinizing the case of the petitioner in the light of the judgment dated 24.02.2015 and the order dated 14.08.2015 passed by the Hon’ble Apex Court and after considering all the aspects and documents available on record recommended for releasing the incremental sales tax amounting to Rs. 62.9139 crore and further to release interest subsidy of Rs.1.2 Crore. Thus, the total incentive of Rs. 64.1139 crore is recommended by the Committee and that a sum of Rs. 22.6988 crore will be disbursed to the petitioner within ten (10) days and for releasing rest of the amount, as that is to be made available from Jharkhand Contingent Fund, 45 days’ time is sought. Undoubtedly, the aforesaid amount of Rs. 22.6988 crore shall be handed over to the petitioner within ten (10) days only and for rest of the amount out of total figure as indicated (Rs. 60 crores) shall be paid to the petitioner by the State within three (3) weeks from today.

1. After hearing learned counsel for both the sides, we are of the considered view that the instant appeal deserves to be admitted. Admitted.

2. I.A. No. 6944 of 2013 stands disposed of observing that the operation of the impugned judgment handed down by learned Single Judge shall remain stayed till the final disposal of the main appeal.

3. Since the instant matter relates to employees, who are asking for increment from a particular date, an effort shall be made to hear the main appeal at the earliest. List again accordingly. Counsel for the respondents states that respective reply/response already filed by them in W.P.(S) No. 4625 of 2013 may be treated as counter affidavit on behalf of the respondents after admission also and they do not intent to provide any other information by way of additional counter affidavit.
