1. it was brought to our notice that the appellants being a public sector undertaking, clearance is required from the committee of secretaries to proceed with the matter as observed by the supreme court in the case of ongc reported in 1992 61 (elt) pg 3 as well as in it's clarificatory judgement in 1994 (70) elt 450 no clearance has been placed on our record. this matter is old. in view of this position this appeal as well as stay application is dismissed for want of clearance.however, the party is at liberty to file an application for restoration as and when clearance is produced. accordingly ordered.

Judgment:


1. It was brought to our notice that the appellants being a public sector undertaking, clearance is required from the committee of secretaries to proceed with the matter as observed by the Supreme Court in the case of ONGC reported in 1992 61 (ELT) pg 3 as well as in it's clarificatory judgement in 1994 (70) ELT 450 No clearance has been placed on our record. This matter is old. In view of this position this appeal as well as stay application is dismissed for want of clearance.

However, the party is at liberty to file an application for restoration as and when clearance is produced. Accordingly ordered.
