2. By the present petition, the petitioner seeks transfer of the Civil Suit No.9292/2016 titled as ‘ICICI Home Finance Co. Ltd. Vs. Prithpal Singh and Anr., pending in the court of Ms.Vineeta Goyal, learned Additional District Judge-03, Saket Courts, New Delhi to the Courts in North-West District, Rohini Delhi.
3. The petitioner submits that he is a resident of Sector-28, Rohini, Delhi. He submits that he is a permanently disabled person. He has placed on record a copy of disability certificate issued by ‘Maharishi Valmiki Hospital’ of the Government of NCT of Delhi dated Tr.P.(C) No.216/2018 Page 1 of 2 12.10.2018 certifying that he is a physically disabled person to the extent of 75% in relation to both his lower limbs.
4. Learned counsel for the respondent has no objection if the petition is transferred from Saket Courts to Rohini Courts.
5. In the circumstances for the expediency of justice, the said Civil Suit No.9292/2016 titled as ‘ICICI Home Finance Co. Ltd. Vs. Prithpal Singh and Anr., is withdrawn from the court of Ms.Vineeta Goyal, learned Additional District Judge-03, Saket Courts, New Delhi and is transferred to the court of learned District & Sessions Judge, North-West District, Rohini, Delhi, who is requested to assign the matter to any competent court under his jurisdiction.
6. The parties are directed to appear before the transferee court on 26.02.2019 at 10 am.
