Occupants Welfare Association and members of respondent No.2/Society praying inter alia for issuance a writ of mandamus to the respondent No.1/RCS to examine the complaints made by them against the purported illegal actions of the respondent No.2/Society which are stated to be in non- conformity with the DCS Act, 2003 and the Rules.
2. On the first call, none was present on behalf of the respondent No.1/RCS. On the second call, Ms. Vaishnavi Rao, Advocate, who has appeared for the Registrar of Co-operative Societies in W.P.(C) 4743/2017 listed today, has been directed to enter appearance in this case as well. A complete set of the paper book shall be furnished to the learned counsel for the respondent No.1/RCS during the course of the day. W.P.(C) 4716/2017 Page 1 of 2 3. Having regard to the limited relief prayed for in the present petition to the effect that the representation dated 11.08.2016 made by the petitioner to the respondent No.1/RCS has not been considered and decided in accordance with law, it is deemed appropriate to dispose of the present petition at the stage of admission by directing the respondent No.1/RCS to examine and consider the said representation and if considered necessary call upon the Managing Committee of the respondent No.2/Society to appear and place their position on record whereafter appropriate orders shall be passed under written intimation to the petitioner No.1 and the respondent No.2/Society. Needful shall be done preferably within three months from today.
