Judgment:
(Prayer: Petition under Article 226 of the Constitution of India, praying for the issue of a Writ of Certiorari, calling for the records pertaining to the impugned charge memo dated 19.10.2015 in Thandanaipatti No.125/2015 issued by the 2nd respondent under Section 17(b) of the Tamil Nadu Civil Services (Discipline and Appeal) Rules and quash the same.)
1. The petitioner/Senthivadivu has come to this Court challenging the correctness of the impugned charge memo dated 19.10.2015 on the ground that the charge memo has been issued arbitrarily without conducting proper enquiry and only on the allegation of her husband regarding the personal character of the petitioner.
2. Learned counsel appearing for the petitioner submitted that only out of personal vengeance, the petitioner's own husband has given a complaint and on the basis of the said complaint, the charge memo has been issued to the petitioner.
3. After some arguments, Mr.R.Narayanan, learned counsel for the petitioner sought permission of the Court to withdraw the writ petition. Accordingly, recording his statement and granting such permission, the writ petition is dismissed as withdrawn. Consequently, M.P.(MD) No.1 of 2015 is also dismissed. No costs.
