Judgment:

(Prayer : Petition filed under Article 226 of the Constitution of India for the issuance of a Writ of Certiorarified Mandamus to call for the records pertaining to the impugned proceedings issued by the 2nd respondent/the General Manager/Disciplinary Authority of Pandyan Gram Bank in his final order Lr AIVD/768/2013-14 dated 4.10.2013 and the appeal order letter issued by the Respondent-1/ The Chairman/Appellate Authority letter AIVD/1063/13-14 dated 27.12.2013 and quash the same and consequently direct the respondents to issue any other order to reimburse all petitioner disallowed and deducted benefits with appropriate interest.)

The petitioner has come to this Court challenging the order dated 04.10.2013 passed by the second respondent, which was confirmed by the appellate authority in letter AIVD/1063/13-14 dated 27.12.2013, with a further direction to issue any other order to reimburse all his disallowed and deducted benefits with appropriate interest. When the petitioner has been issued with an order of punishment of reduction of pay to next lower stage in the scale of pay for a period of two years in terms of Regulation-39(2)(b) and (iv) of Pandyan Grama Bank (Officers and Employes) 2010, in terms of Regulation 39(2)(b) and (vi) of Pandyan Grama Bank (Officers and Employees) 2010 by the General Manager on 04.10.2013, the same was also confirmed in the appeal on 27.12.2013. Being so, the petitioner having kept quite almost for about three years, cannot come to this Court, for the simple reason that this Court will not help a person, who was sleeping over the matter. In the present case also, the petitioner slept over the matter almost for a period of three years. Therefore, the Writ Petition suffers from guilty of laches. Accordingly, the Writ Petition fails and the same is dismissed. No costs. Consequently, connected miscellaneous petition is also dismissed.
