The writ petition has been filed seeking for the issuance of a Writ of Mandamus, to direct the Respondents herein to grant permission to conduct the ".Aadalum Paadalum". dance Programme on 04.10.2014 from 8.00 p.m. to 12.00 p.m., in pursuant to the 'Kodai Vizha Festival' of the Sree Agalikkaraisamy Thirukoil, Umarikadu Village, Srivaikumdam Taluk, Thoothukudi District by considering the Petitioner's representation dated 22.09.2014. 2.By consent, the writ petition itself is taken up for final disposal. 3.Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader appearing for the respondents. 4.In the affidavit it has been stated that the petitioner, who is residing at Umarikadu, Srivaikundam Taluk, Thoothukudi District and others have decided to conduct 'Kodai Vizha Festival' of Sree Agalikkaraisamy Thirukoil, Umarikadu Village, Srivaikumdam Taluk, Thoothukudi District and fixed the date of celebration from 01.10.2014 to 04.10.2014. It is further stated that they have decided to conduct ".Aadal Padal". programme on 04.10.2014 and hence, he approached the second respondent on 22.09.2014 to provide police protection and the second respondent did not consider the same. Aggrieved over the same, the present writ petition has been filed. 5.Today when the matter is taken up for hearing, the learned Additional Government Pleader submitted that on an earlier occasion, this Court by accepting the submission of the learned Government Advocate, imposed 23 conditions to conduct Aadal Padal programme in W.P.(MD).No.3528 of 2014, and if the same conditions are imposed the respondent will consider the application of the petitioner. 6. The learned Additional Government Pleader would further submit that the organizers of the function should pay the charges for the police protection in terms of the Police Standing Order.
7. The learned counsel appearing on behalf of the petitioner submits that the petitioner would abide by all the above said 23 conditions, which are enumerated by the second respondent Police and ready to pay the charges for police protection. T.S.SIVAGNANAM, J.
sj 8. In view of the above, the second respondent Police is directed to give necessary permission by imposing the above said conditions for conducting the festival. Further, this Court directs the second respondent police to pass necessary orders on or before 27.09.2014 incorporating the conditions as enumerated above.
