(Order of the Court was made by S.MANIKUMAR ,J.) R.Padmaraja, has sought for writ for Habeas Corpus directing the Superintendent of Police, Ramanathapuram District, Ramanathapuram, and the Inspector of Police, Ramanathapuram Police Station, Ramanathapuram District, to produce Mr.Raguram, aged about 56 years and son of K.S.D.Rajendran, before this Court.

2. According to the petitioner, the alleged detenu is his father. In his supporting affidavit, he has submitted that his father Raguram, S/o.K.S.D.Rajendran, was a Jamin of Pallayampatti Jamin family. He owns several valuable properties. He was legally separated from the petitioner's mother. Respondent No.3, who is the brother-in-law of the detenu, is an influential person with political strength. According to the petitioner, respondent No.4, is the driver of the alleged detenu and respondent No.5 is the manager of Palayampatti Jamin, Ramanathapuram District. The petitioner has further submitted that he is doing business at Chennai and used to have frequent contacts with his father. Recently, his father has been missing from the petitioner's native town. When he enquired, his grand-mother, Mrs.Padmarani, has replied that his father Raguram, had been detained by respondents 3 to 5, by administering drugs. The petitioner has further stated that when he requested respondents 3 to 5, to release his father, there was no answer. Instead, the petitioner only received threat from unknown quarters. Therefore, in the abovesaid circumstances, the petitioner was constrained to lodge a complaint dated 02.07.2014 to the Superintendent of Police, Ramanathapuram District, Ramanathapuram, who in turn has forwarded the same, to the Inspector of Police, Ramanathapuram Police Station, respondent No.2. Though the complaint has been registered in Petition No.302/2014, as the respondent No.3, is an influential person, and wanted to grab the properties from the petitioner's father, by use of threat, no action has been taken. On the above facts, the petitioner has sought for writ of Habeas Corpus.

3. The complaint dated 02.07.2014 addressed to the official respondent and 'Dinamalar' paper news dated 03.07.2014 are enclosed in the typed set of papers. Mr.K.Chellapandian, Additional Advocate General, State of Tamilnadu, took notice for respondents 1 and 2. Notice to private respondents through Court and privately was ordered.

On this day, when the matter came up for hearing, Mr.K.Chellapandian, learned Additional Advocate General, State of Tamilnadu, also produced photo copies of the statements recorded from respondent No.3, Mr.A.Ramalingam, mother of the alleged detenu, Mrs.Padma, alleged detenu, Mr.R.Raguram, respondent No.5, Mr.Balamurali and Doctor Joshyi George, MA, Msc, Mphil, PhD (Psycho analyst), Chairman of a Unit of Wisdom Medical Research Foundation Trust. Treatment record dated 12.08.2014 of Mr.R.Reguram, the alleged detenu, is also produced.

From the perusal of the statements recorded by the police and in particular, the statement of alleged detenu, R.Raguram, made in presence of Doctor Joshy George, MA, Msc, Mphil, PhD (Psycho analyst), who is currently giving treatment, it is abundantly clear that the alleged detenu is an inpatient in a hospital and taking treatment. According to the Doctor, he has no visitor other than his mother and sisters. The patient has recovered from addiction and is on recovering path, co-operating with all treatment. Relevant materials are placed before this Court to support the statement. As the alleged detenu is taking treatment, it would not be desirable to direct production of the detenu, before this Court.

Though, Mr.K.P.Narayanakumar, learned counsel for the petitioner submitted that because of the high influence of respondent No.3, police have obtained statements from the other private respondents refuting the allegations of detention, we are not inclined to accept the said contention. From the perusal of the statements given by the private respondents and the typed set of papers filed by respondents 4 and 5 it is clear that due to difference between the spouses, Mr.Raguram, alleged detenu, has filed HMOP No.298/2006, against Vijayalakshmi, mother of the petitioner, for a decree, for divorce. Thereafter, on the endorsement made by the petitioner, in HMOP No.298/2006 on the file of Family Court, Madurai, the said petition has been withdrawn and that the same has been dismissed on 29.04.2007. Subsequently, both Mr.R.Raguram and Vijayalakshmi, have jointly filed HMOP No.168 of 2007, on the file of Family Court, Madurai, under Section 13(B) of the Hindu Marriage Act, and prayed for a divorce, on mutual consent. As per the joint averments, Mrs.Vijayalakshmi has received a sum of Rs.20,00,000/- for the past and future maintenance for herself. Mr.Raguram, the alleged detenu has deposited a sum of Rs.50,00,000/- in a fixed deposit in the State Bank of India, for the future maintenance, for the then minor child R.Padmaraja @ Aswin, the petitioner herein. Both the petitioners in HMOP No.168 of 2007 have been examined as PW-1 and PW-2 respectively, and Ex.P-1 Marriage invitation, dated 18.10.1989 and Ex.P-2 xerox copy of compromise memo in the partition suit in O.S.No.124/2006 on the file of I Additional District Court, Madurai, have been marked. After extracting the pleadings and considering the oral and documentary evidence, the learned Family Court Judge, Madurai, has passed the following order;- ".4.After perusing the petition filed by both the petitioners and evidence of P.W.1/the 1st petitioner and evidence of P.W.2/the 2nd petitioner and the Marriage invitation marked as Ex.P1 and the compromise petition in the partition suit O.S.No.124/2006 on teh file of I Additional District Court, Madurai in xerox copy marked as Ex.P2, this court comes to a conclusion as follows: It seems that the marriage soleminsed on 18.10.89 was irretrievably broken down and there would be no point is making an effort to bring about the conciliation between the parties. Teh 1st petitioner agreed to give a sum of Rs.20,00,000/- (Rupees Twenty lakhs) towards lifetime maintenance to the 2nd petitioner and the 2nd petitioner received the same, and 1st petitioner has deposited Rs.50,00,000/- in fixed deposit in State Bank of India for the future maintenance to the minor child namely Padmarajan alies Aswin. In these circumstances, this Court comes to a conclusion to allow this petition and to dissolve their marriage solemnized on 18.10.1989 between the petitioners by passing a decree for divorce by mutual consent u/s.13(B) of Hindu Marriage Act without costs. Finally this petition is allowed as prayed for by granting an order divorce on mutual consent and thereby the marriage held on 18.10.1989 between the petitioners is dissolved. No order as to costs.".

Subsequently in the suit, I.A.No.438/2008, dated 26.07.2008, he has been declared as major.

While properties have been included in the decree dated 26.11.2008 in O.S.No.124 of 2006, both, in favour of mother Mrs.Vijayalakshmi and her son R.Padmaraja, the writ petitioner herein, making allegations that the third respondent, has intended to grab money and property, from the petitioner's father R.Raguram, and for that purpose has kept him, under illegal custody, the habeas Corpus Petition has been filed.

9. Perusal of the statement recorded from the respondent No.3, shows that he is the brother-in-law of the alleged detenu. According to him, due to family dispute and misunderstanding, Mr.Raguram was addicted to drinks. On 04.02.2008 there was a consent decree of divorce. For future maintenance of the alleged detenu's wife Vijayalakshmi, a sum of Rs.20,00,000/- and for his son, i.e. the writ petitioner, a sum of Rs.50,00,000/- respectively, have been deposited in SBI. In addition to the above, a coconut groove in Thirupoovanam, worth Rs.1.25 crores, has been given to Mr.Padmaraja, the writ petitioner. The third respondent in his statement before the police has further stated that earlier, Mr.Raguram, was living with his parents at Madurai. The detenu's father K.S.D.Rajendran, admitted the detenu in D.D.K. Centre, Adayar Chennai. Thereafter, from 2003 onwards, Mr.Raguram has been taking treatment in Punar Jeevan a Unit of Wisdom Medical Research Foundation Trust, at No.40, VPG Avenue Extension, Mettukuppam, Chennai-600 097. When the father of Mr.Raguram died in Madurai, he took Mr.Raguram to Madurai and he attended the funeral ceremony. Thereafter, Mr.Raguram, continued his treatment at Punar Jeevan. The third respondent' wife, mother-in-law, sister-in-law, namely Mrs.Rajeswari, and his son, would made enquiries about his health. Due to pressure of work, from 2010, his visit to the hospital was not frequent. In his statement before the police, he has also stated that he has never met Padmaraja, the writ petitioner herein, nor spoken to him over phone. He has denied the allegation of detention. According to him, allegations made, are only to malign his reputation. He has also stated that Mr.Raguram, is continuing his treatment at the above centre.

10. As per the statement of Smt.Padma, mother of the alleged detenu, dated 14.08.2014, she has two daughters Mrs.Rajeswari and Maheswari. Mr.Raguram is her son. According to her, currently she is living with her daughter Mrs.Rajeswari and her son-in-law Mr.A.Ramalaingam, the third respondent herein. She has stated that her son, Mr.Raguram was addicted to drinks. He was treated in a Hospital at Adayar, Chennai. She has further stated that she had seen the writ petitioner, when he was young and when her husband K.S.D.Rajendran died at Madurai. Thereafter, she has neither seen Mr.Padmaraja, the writ petitioner, nor spoken to him, over phone. In her statement, she has also categorically denied that the writ petitioner had spoken to her, about the missing of Mr.Raguram. According to her, the alleged detenue was not kidnapped or illegally detained by any body. But, as on today, he is undergoing treatment in Punar Jeevan, a De-addiction centre, Mettukuppam, Chennai and that the entire medical expenses is incurred by her.

11. Mr.Balamurali, the respondent No.5, stated to be the Manager of Pallayampatti Jamin Estate, has given a statement to the police that since 2009, he has been working as Manager. He has been maintaining the accounts and properties belonging to Pallayampatti Jamin Estate. According to him, mother of the alleged detenu, Smt.Padma continued to the guardian of the properties belonging to Mr.Raguram. He has also stated that when the father of the alleged detenu K.S.D.Rajendran died, at Madurai, the third respondent helped Mr.Raguram to visit Madurai by air. He has denied the allegation of administring any drugs, by anybody. He has also denied the allegation that he was contacted by the writ petitioner.

12. We have also perused the statements of the alleged detenu, Mr.Raguram, aged about 47 years. According to him, he is currently taking treatment at Punar Jeevan, at No.40, VPG Avenue Extension, Mettukuppam, Chennai-600097 a unit of Wisdom Medical Research Foundation Trust, for De- addiction. In 2001, he was taking treatment in Wisdom Hospital, Kodambakkam, Chennai. In his statement, he has also referred to about the HMOP and the settlement of properties made in favour of the writ petitioner. He has also stated that when father died at Madurai, respondent No.3 took him to Madurai. Thereafter, he continued his treatment. According to him, he had not met Mr.Padmaraja, the writ petitioner or spoken to him, over phone. He also denied the allegations made against respondents 3 to 5.

Photocopies of the statement recorded by the police shows that it is signed by the alleged detenu and that the statement has been recorded in the presence of Doctor, Joshy George, Chairman of Wisdom Medical Research Foundation Trust, at No.40, VPG Avenue Extention, Mettukuppam, Chennai- 600097. Statement bears the seal of the said Foundation. Dr.Joshy George, has also given a statement to the police that he has been running a De-addiction centre, since 2003. Earlier, he was the Managing Director of Wisdom Hospital, Mahalingapuram, Kodambakkam, Chennai. In his statement, he has stated that the alleged detenu has been taking treatment for many years. Except the alleged detenu's sisters Mrs.R.Rajeswari, Mrs.Maheswari, his mother Mrs.R.S.Padma, Puliampatti Estate Manager, Mr.Balamurali, neither the petitioner nor his relatives, have visited the hospital. As per the version of the Doctor. Joshy George, and Chairman of Wisdom Medical Research Foundation, at No.40, VPG Avenue Extension, Mettukuppam, Chennai -600 097, Mr.Raguram, has been taking treatment on his own. According to the Doctor, earlier, he had also accompanied the alleged detenu to Madurai, when the latter wanted to see his parents.

14. Mr.V.Shanmugaraja, respondent No.4, stated to be the driver of the alleged detenu, in his statement has also denied the allegations of kidnapping and detention. As per his statement, after the decree of divorce, Mr.Raguram, did not meet the petitioner. He has also denied telephonic conversation with the writ petitioner. ' 15. In all the statements recorded by the Inspector of Police, Ramanathapuram District, Ramanathapuram, the third respondent, Mr.A.Ramalingam, mother of the detenu, (Mrs.R.S.Padma), the alleged detenu, Mr.Raguram, Mr.Balamurali, the fifth respondent and Dr.Joshy George, their signatures are found. Though the learned counsel for the petitioner submitted that statements have been recorded under the influence of respondent No.3, this Court is not inclined to accept the same. Certificate, dated 12.08.2014 issued by Mrs.Padmapriya, Sr.Counselor/Porject Secretary, makes it abundantly clear that Mr.R.Raguram, has been taking treatment from December-2003 itself, and that he has been taking treatment continuously. Recitals of the said certificate reads as follows:- ".This is to certify that Mr.R.Reguram son of Late His Highnes Mr.K.S.D.Rajendran aged about 47 years resident of No.154, Alagar Koil Street, Tallakulam, Madurai-2 was admitted in our hospital for Multiple substance abuse induced psychosis from 2003 December and earlier in Wisdom Hospital which was also run by Dr.Joshy George. He is admitted by his father Late His Highness Mr.K.S.D.Rajendran and after his demise his mother took over as his guardian paying all his treatment charges till date. He has no other visitor than his mother and sister's. The patient has recovered from addiction and he is on reocvering path, co-operating with all our treatment. Now the patient is on following drugs:". Though the learned counsel for the petitioner submitted that influence has been exerted on the doctor, for issuing the abovesaid certificate dated 12.08.2014, going through the entire material record, including the judgment and decrees stated supra, and statements recorded by the police, with the signatures, of the parties against whom, allegations have been made, we are not inclined to accept the contention of the learned counsel for the petitioner that the medical record certificate issued by Mrs.Padmapriya (Sr.Counselor/Project Secretary) for Punar Jeevan was due to undue influence. We are not inclined to accept the plea of any undue influence exerted by the third respondent. The contents of the complaint dated 02.07.2014 alleging that the detenu was administered drugs by the private respondents and thus, he became addicted to the same and the further allegation that the detenu is kept in an unknown place and that there is a threat to his life, are not substantiated. On the contra, perusal of the statements, and certificate issued by the Wisdom Medical Research Foundation Trust, makes it clear that the mother of the alleged detenu is taking care of her son Mr.R.Raguram. Senior Counselor/Project Secretary of the Wisdom Medical Research Foundation Trust, has also stated that the patient Mr.Raguram has recovered from addiction, and that he is on recovering path, and co-operating with the treatment.

17. By making a bald allegation of detention, by the private respondents, writ of Habeas Corpus has been filed. There is no evidence to prove that the petitioner has contacted the mother of the alleged detenu. Mere averments made in the affidavit does not amount to proof. In a proceeding under Article 226 of the Constitution of India, there should be atleast some evidence to consider the case of alleged detention. On the facts and circumstances of this case, there is absolutely no evidence to prove that he has contacted the mother of the allege detenu. On the contra, she has denied the same. Dr.Joshy George, has denied the averment of administering drugs, on the contra has stated that the alleged detenu, has been under treatment for deaddiction. Treatment record has been placed before this Court. True copies of the statements signed by the third respondent, Mr.A.Ramalingam, the mother of the detenu, Smt.R.S.Padma, the alleged detenu, Mr.Raguram, Mr.Balamurali, the fifth respondent, and Dr.Joshy George, and the certificate dated 12.08.2014 signed by Mrs.Padmapriya (Sr.Counselor/Project Secretary), shall be treated as part of record along with the main writ petition. Detention has not established.

Before parting with the case, we deem it fit to state, though the Hon'ble Apex Court has distinguished the nature of pleadings and evidence required to be produced by the writ petitioner, in a proceedings under Article 226 of the Constitution of India, and a civil proceeding, unmindful of the same, petitions are being filed, without any evidence. Allegations of serious nature of detention, are made without any evidence. A party to lis may be an influential person in the Society. Merely because, he is influential and holding a high office, that itself is not a ground to attribute something against him. Before the Court of law, everybody is equal. Malafiedes if any, attributed, should be substantiated by evidence. Mere averments do not amount to proof. Every averment made in the affidavit, has to be construed as proof, and when the same is refuted, Courts cannot conduct a roving enquiry, into all the allegations made in the supporting affidavit, without any iota of evidence. Allegations made against the third respondent is not substantiated. There are no merits in the Petition. For the reasons stated supra, Habeas Corpus Petition is dismissed.
