17. h September, 2014. PRESENT HON'BLE Dr. JUSTICE VINEET KOTHARI Appearance: None present for the petitioner. -- BY THE COURT:

1. None is present on behalf of petitioner, though name of Mr. S.D. Purohit, is shown in the cause list.

2. The present writ petition has been filed by the petitioner on 11.03.2014 seeking following relief(s): - “It is, therefore, humbly and respectfully prayed that writ petition may kindly be allowed with costs and by an appropriate writ, order or direction, the respondents No.1 and 2 may kindly be directed to give appointment to the petitioner on the post of L.D.C. through promotion from the date the respondent No.3 was given appointment through promotion on the post of L.D.C. Any other appropriate order or direction, which may be deemed just and proper in the facts S.B. CIVIL WRIT PETITION No.1965/2014. Sushil Kumar Vs. State of Rajasthan & Ors. Order dated 17/09/2014 2/2 and circumstances of the case, may kindly be passed in favour of the petitioner.”. 3. The petitioner, who was initially appointed as Class IV employee on 18.11.1998 in Motor Accident Claims Tribunal, submitted his application for appointment to the post of Lower Division Clerk through promotion. According to petitioner, as per the Senior List (Annex.2), he was senior to the private respondent No.3, namely, Sher Mohd., and his name was recommended for such promotion by the respodnent No.2, Judge, MACT, Udaipur, however, ignoring his candidature, the private respondent No.3 has been so promoted.

4. The petitioner before approaching this Court, sent a legal notice for demand of justice through his counsel on 19.09.2013 (Annex.7) to the Secretary, Local & Legal Affairs Department, Govt. of Rajasthan, Jaipur, however, the same was not responded to by the respondents.

5. Having perused the record, the present writ petition is disposed of with a direction to the respondent No.1, Secretary, Local & Legal Affairs Department, Government of Rajasthan, Jaipur, to decide the pending legal notice/representation within a period of three months from today. No costs. A copy of this order be sent to the concerned parties forthwith. (Dr. VINEET KOTHARI), J.
