Appearance: Mr.Santosh Kumar Ray, Advocate The Court: This is an application for execution of an award/decree dated 30th July, 2013.
It is submitted by the learned counsel for the decree-holder that out of the two assets, one asset has been taken possession of on 25th January, 2013 and the same was sold at Rs.15,40,000/-.
In this regard a supplementary affidavit has been filed by the decree-holder.
In the supplementary affidavit the decree-holder has adjusted the sale proceeds and further claims a sum of Rs.39,81,187/-.
The supplementary affidavit filed by the decree-holder is taken on record.
No notice of this application is to be served upon the judgement debtor at this stage.
Order in terms of prayers (b) and (c) of the column 10 of the tabular statement, restricted to the 01 No.Rock Breaker bearing Machine Serial No.7326 which is hypothecated with the decreeholder.
No sale without the confirmation of the Court.
Mr.Soumitra Mukherjee, Advocate, Bar Association Room No.1, and Ms.Hasi Saha, Advocate of Bar Association, are appointed as Joint Receivers at a remuneration of 600 GMs each to be paid by the decree-holder.
The Joint Receivers are empowered to appoint an agent and file a report by the returnable date.
The Joint Receivers may act jointly or severally.
The Jurisdictional Superintendent of Police is to render all assistance to the Joint ReceiveRs.I direct the Advocate on record for the decree-holder to serve copies of the execution application on the judgement debtor.
I make this application returnable on 26th August, 2014.
Certified photocopy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
