(Oral) The short grievance of the petitioner is that she is a bonafide purchaser of plot No.1066, Part-II, Sector-15, Gurgaon, for consideration.

The plot was purchased by the petitioner from its previous owner Col.B.S.Guraya, after seeking permission from the Competent Authority and re- allotment letter has been issued in her favour.

The petitioner applied for execution of conveyance deed but the same has been refused by the Estate Officer, HUDA, Gurgaon, presumably on account of an interim order dated 05.07.1993 passed by the Special Judge, Chandigarh in a criminal case arising out of FIR No.15 dated 06.08.1990 registered against Col.

B.S.Guraya under the Prevention of Corruption Act, 1988.

Vide the above-stated interim order, the Special Judge, Chandigarh, directed the Estate Officer, HUDA, Gurgaon, not to allow the transfer/to sell/alienate the plot in question till further ordeRs.The petitioner purchased the above-said plot Kumar Mohinder 2014.07.25 12:36 I attest to the accuracy of this order Chandigarh CWP No.3674 of 2014 [2].before the above-stated interim order was communicated.

Since conveyance deed has not been executed in petitioner's favour apparently on account of interim order dated 05.07.1993 passed by Special Judge, Chandigarh, we dispose of this writ petition at this stage with liberty to the petitioner to move an appropriate application before the said Court for modification/recall of the order dated 05.07.1993.

The petitioner's application, if any, shall be decided by the Special Judge, Chandigarh, within a period of four months from the date of its filing.

If the petitioner is still aggrieved, liberty is granted to her to approach the appropriate forum.

Ordered accordingly.
