(Oral) Prayer made in the petition is for the grant of anticipatory bail to the petitioners in case FIR No.101 dated 17.5.2014 under Sections 380/427/506/148/149 IPC registered at Police Station Beas, District Amritsar.
While issuing notice, a co-ordinate Bench of this Court vide order dated 5.6.2014 directed the release of the petitioners on interim bail in the event of their arrest subject to their furnishing appropriate bonds to the satisfaction of Arresting/Investigating Officer.
They were also directed to join the investigation as and when called upon to do so.
Learned State counsel, after obtaining instructions CRM M-20056 of 2014 -2- from ASI Joginder Singh, has informed the Court that though all the three petitioners have joined the investigation and, therefore, no required for custodial interrogation yet Kanwalpreet Singh- petitioner stands arrested in FIR No.179 dated 20.7.2014 under Sections 307/452 IPC and Section 25 of the Arms Act, Police Station Beas, District Amritsar and is presently behind the baRs.Learned counsel for the complainant has opposed the prayer made on behalf of the petitioners by submitting that the petitioners took law in their hands in committing the crime.
At this stage, learned counsel for the petitioners states that he does not press the present petition qua Kanwalpreet Singh-petitioner.
After hearing learned counsel for the parties, this Court is of the considered view that Santokh Kaur and Jatinder Kaur-petitioners deserve the concession of anticipatory bail.
Resultantly, the petition qua Kanwalpreet Singh is dismissed as not pressed.
However, the same qua Santokh Kaur and Jatinder Kaur-petitioners is allowed and the ad-interim order dated 5.6.2014 is made absolute.
