It is stated that as per advertisement, to be eligible for the said post, the candidate is required to have to his/her credit Certificate of passing National Eligibility Test (in short “NET”.) and State Level Eligibility Test (in short “SLET”.).The petitioners did not possess that certificate and as such they failed to apply for the said post.
No attempt was made by them to challenge the said advertisement as was done by many otheRs.They kept on sleeping.
Other candidates approached this Court and their writ petition was allowed vide order dated 19.2.2014.
It was directed that the candidates who had to their credit Ph.D degree, they are not required to pass eligibility test as referred to above.
The respondents were directed to accept their applications within ten days from the above said date i.e.Atul Kumar Tripathi 2014.07.17 14:39 I attest to the accuracy and integrity of this document Chandigarh CWP No.8739 of 2014 (O&M) -2- 19.2.2014.
There is paucity of lecturers in Schools and the children are suffering.
Idea was not to delay the process of selection.
The petitioners kept on sleeping when advertisement was issued and never made an attempt to challenge the same as was done by many otheRs.They never made an attempt to get benefit of the instructions issued by the University Grants Commission making a candidate having Ph.D degree to his/her credit eligible for the post of Assistant Professor.
Those having Ph.D degree to their credit approached this Court and their writ petition was allowed on 19.2.2014.
The decision taken was even highlighted by the Press.
To claim relief, reliance has been placed upon the judgment passed by this Court in Jugal Kishore v.
State of Haryana and Others 2009(3) S.C.T.433.
No benefit of the said judgment can be given to the appellant.
That was a case where benefit of grant of higher pay scale was claimed.
In that case, general observations were made keeping in view the fact of non-payment of higher pay scales.
No case is made out to cause interference by this Court in the present petition.
Dismissed.
