(ORAL) Petitioners have approached this Court with a grievance that they have not been granted the initial increments on completion of the one year service and in fact, the fiRs.increment was granted after a span of 18 months.
Reference has also been made to the order passed by this Court in CWP No.16795 of 2010 titled as Ramesh Kumar and others versus State of Haryana and otheRs.where Rule 10 of the Haryana Civil Services (Revised Pay) Rules, 2008 has been struck down.
Copy of the judgment has been appended as Annexure P-5 dated 20.07.2011.
The State of Haryana has accepted the said judgment and has issued Instructions dated 16.04.2012.
PetitioneRs.on the basis of the said judgment and the Instructions of the Government of Haryana, have approached the respondents by way of representation dated 31.07.2012 (Annexure Prerna dattaP-6) by petitioner No.1 but without any response.
2014.07.14 11:45 I attest to the accuracy and integrity of this document High Court, Chandigarh CWP No.13184 of 2014 2 Counsel for the petitioners states that liberty may be granted to the petitioners to file a detailed representation to the Engineer-in-Chief, PWD (B&R).Haryana-respondent No.2 as also the Superintending Engineer, PWD (B&R) Haryana, who may be directed to consider and decide the said representation, which would be filed within a period of three weeks' from today, within some specified time.
In the light of the submissions made by the counsel for the petitioners and without going into the merits of the case or commenting thereon, the present writ petition is disposed of with liberty to the petitioners to file a detailed representation to the Engineer-in-Chief, PWD (B&R).Haryana-respondent No.2 as also the Superintending Engineer, PWD (B&R) Haryana, within a period of three weeks' from today, which shall be considered and decided by the said authorities within a period of two months' from the date of submission of such representation.
In case the claim of the petitioners is accepted, the consequential benefits, if any, be released to them, in accordance with law, within a further period of one month.
In case the claim of the petitioners is not to be accepted, a well-reasoned and speaking order be passed and conveyed to them forthwith.
