.....approached this court under section 407 of the code of criminal procedure for transfer/clubbing the case fir no.29 dated 4.6.2011 for offence under sections 323, 324, 326, 148, 149, 506 of the indian penal code (for short “ipc”.).registered at police station, mattewal, district amritsar rural to a competent court at batala where the case vide fir no.72 dated 5.6.2011 for offence under sections 323, 324, 326, 148, 149 ipc, registered at police station, sadar batala is pending. perusal of averments set up in the petition makes it evident that as per version recorded in the two aforesaid firs.place of occurrence is stated to be different. this apart, in the case registered by the petitioner, cancellation report has been submitted which is pending consideration saini paramjit kaur 2014.07.08 09:52 i attest to the accuracy and integrity of this document chandigarh crl. misc. m-17021 of 2014 -2- before the court in view of alleged protest petition filed by the petitioner. keeping in view the above, i do not find any merit in the contentions of the petitioner that the two aforementioned cases are required to be dealt with by the same court. dismissed.
