Jasbir Singh, Judge (Oral) Appellant retired from service on 31.3.2011.
When releasing his retiral benefits, it was found that excess amount to the extent of ` 39,022 was paid to him.
He came to this Court by filing Civil Writ Petition No.2136 of 2012 which was dismissed by the learned Single Judge vide order dated 4.2.2014.
The said order is under challenge in this appeal.
It has vehemently been contended that mistake, in showing excess amount in the General Provident Fund account of the appellant, had occurred in the year 1995-96.
There was no misrepresentation on the part of the appellant in getting that wrong entry made and as such at this stage, the said amount cannot be recovered.
It has rightly been noted by the learned Single Judge that at the end of every year, it is mandatory for the department to send accounts statement of General Bhardwaj Deepak Kumar 2014.07.07 13:24 I attest to the accuracy and integrity of this document Letters Patent Appeal No.396 of 2014 (O&M) 2 Provident Fund Account to the employee and to confirm correctness of the amount shown, a declaration is to be filed by the employee confirming the entries conveyed to him.
In this case, when wrong entry was conveyed to the appellant in the year 1995-96, he failed to indicate the same by filing a declaration that amount has wrongly been shown in his account.
Whereas, as per facts on record, he has already withdrawn amount from the General Provident Fund Account more than the amount shown in the annual statement.
It is implied misstatement of the appellant.
No case is made out to cause interference by this Court in the present appeal.
Dismissed.
