Petition filed under Section 439 Cr.P.C.

2. The petitioner is the accused in Crime No.689/2014 of Aluva West Police Station, which has been registered for offences under Sections 465, 468, 471 and 511 of 420 of IPC.

3. The allegation against her is that on the strength of some forged documents she made a promise to make arrangements for participation of certain people in a cricket tournament and she attempted to cheat them of certain amounts.

4. The learned counsel for the petitioner submits that the documents mentioned by the prosecution are genuine and in view of the fact that the petitioner has been in custody since 15.06.2014, she may be released on bail. B.A. No. 4691 of 2014 -2- 5. Heard the learned counsel for the petitioner and the learned Public Prosecutor.

6. The petitioner is a 43 year old housewife. The police have recovered certain documents from her, which are said to be false. She attempted to take money from certain people on the strength of those documents promising that she would make arrangements for their participation in a cricket tournament.

7. Prima facie she has committed the offences alleged against her. It is submitted that she is not involved in any other criminal case and her further detention is not necessary for completion of the investigation.

8. In the result this application is allowed. i. The petitioner shall be released on bail on her executing a bond for Rs.1,00,000/- (Rupees One lakh only) with two solvent sureties each for the like sum to the satisfaction of the learned Magistrate concerned. B.A. No. 4691 of 2014 -3- ii. The petitioner shall appear before the Investigating Officer between 10.30 am and 11.30 am on every Friday for one month and on the first and third Saturdays for the second month, unless final report is filed earlier. iii. The petitioner shall not intimidate the witnesses or attempt to influence them. iv. The petitioner shall not get herself involved in any other criminal case while she is on bail. v. The petitioner shall surrender her passport before the learned Magistrate and if she does not have one, she shall file affidavit within one week of her release.
